Abstract:

The analysis of the transformation and rapid evolution of the contemporary society requires the reconsideration of the nature and functions of intellectual property institutions, under penalty of their survival and their future. Evident is the actual detachment of the law from the reality of the world that surrounds us and its challenges with which we must confront, detachment that goes well beyond the physiological delay with which the norm tends to adapt to changes and to register the new emerging interests in the community.
